ExaStash("we", "us", or "our") respects intellectual property rights and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we will respond expeditiously to claims of copyright infringement committed using our service.
How to Send a DMCA Notice
In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), you may report copyright infringement to ExaStashusing either method below. Both reach the same review queue and follow the same 24–48 hour SLA.
Online form: Use the takedown form at the bottom of this page. This is the fastest path and lets you attach all required information in one submission.
Email: [email protected] — include all the same fields the form requests (your contact information, identification of the work, infringing URLs, and the required good-faith and perjury statements).
Our designated DMCA agent is registered with the U.S. Copyright Office. Full postal-address details are on file with the Copyright Office's public agent directory at dmca.copyright.gov.
Repeat Infringer Policy
ExaStash maintains a policy for termination of users who are repeat infringers of intellectual property rights:
- First violation: Warning + content removal
- Second violation: Warning + content removal + 30-day upload restriction
- Third violation: Permanent account termination
A "strike" is issued when a valid DMCA takedown notice is received and no valid counter-notice is filed within 10 business days. Strikes expire after 12 months of good standing.
Counter-Notice Process
If you believe your content was removed in error, you may submit a counter-notice to our designated agent. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the removed material and its location before removal
- A statement under penalty of perjury that the material was removed by mistake
- Your name, address, and phone number
- Consent to jurisdiction of Federal District Court
- Statement accepting service of process from complaining party
Upon receiving a valid counter-notice, we will forward it to the original complainant and restore the content within 10-14 business days unless the complainant files a lawsuit.
