By accessing or using ExaStash ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

ExaStash is a file hosting platform that allows users to upload, store, share, and monetize files. The Service includes web and mobile applications, APIs, and related services.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3a. Age Requirement

You must be at least 18 years old to create a ExaStash account. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms in your jurisdiction. We collect your date of birth at signup and retain it to satisfy regulatory obligations (US COPPA, EU GDPR Article 8, India IT Rules 2021, and analogous laws). Accounts later found to belong to a person under 18 will be terminated and content removed.

Parents or guardians who believe a minor has registered an account in violation of this section may contact us at [email protected] for immediate removal.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, share, or distribute illegal content
  • Infringe on intellectual property rights of others
  • Distribute malware, viruses, or harmful code
  • Engage in fraudulent activities or view manipulation
  • Harass, abuse, or harm other users
  • Violate any applicable laws or regulations

5. Content Ownership

You retain ownership of content you upload to ExaStash. By uploading content, you grant us a non-exclusive, worldwide license to host, store, and distribute your content as necessary to provide the Service.

6. Creator Earnings

Creators may earn revenue through the platform's monetization features. Earnings are calculated based on verified views and ad revenue. We reserve the right to:

  • Adjust earnings calculations to prevent fraud
  • Withhold payments pending verification
  • Deduct taxes as required by law
  • Set minimum payout thresholds

7. DMCA and Copyright

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyright has been infringed, please submit a takedown notice to our designated agent. See our DMCA Policy for details.

Repeat infringers will have their accounts terminated under our three-strike policy.

8. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination:

  • Your access to the Service will be revoked
  • Your uploaded content may be deleted
  • Pending earnings may be forfeited if termination is due to fraud

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR SPECIFIC RESULTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISKAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be resolved in the courts of Mumbai, Maharashtra.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
